Closing & funding
In Virginia a title company, attorney, broker, or bank may serve as settlement agent under CRESPA, and the Wet Settlement Act governs timing. Closings are wet, with funds held through rescission.
Spousal signing
Virginia abolished dower and curtesy in 1991. A non-titled spouse does not have to sign a refinance on singly-titled property. Your title underwriter confirms vesting.
Taxes on a refinance
Virginia charges recordation on the deed of trust but at a reduced refinance rate of $0.18 per $100 on the first tier, plus state and local pieces, when the prior deed book and page are cited. That refinance rate is the saver to ask about.
Cash-out & rules
Cash-out loan-to-value follows investor and agency guidelines, not a state cap. Virginia applies a 12-month anti-flipping net-benefit test on refinances.
