Refinancing in Utah: what to know

Closing & funding

Utah is an escrow state; a title or escrow company closes the refinance. Utah follows a good-funds regime that behaves like dry funding, so recording and disbursement can lag signing.

Spousal signing

Utah is common-law. A non-titled spouse generally does not have to sign a refinance; homestead here is a claimable exemption rather than a forced-joinder rule. Confirm vesting with your title underwriter.

Taxes on a refinance

Utah does not impose a special tax on a refinance. Expect recording fees only, since a refinance does not create a new deed transfer.

Cash-out & rules

Cash-out loan-to-value follows investor and agency guidelines, not a state cap. Utah has a High Cost Home Loan Act that can add protections on qualifying loans.

Good to know

Utah uses non-judicial foreclosure. A statewide prepayment-penalty ban takes effect May 6, 2026, and remote online notarization is generally available.
