New Mexico is an escrow state and refinances are dry-funded: documents sign and record first, with funds disbursing afterward. The federal three-day right to cancel also applies on a primary residence.

Spousal signing

On a non-purchase-money refinance of community real estate, both spouses generally must join; a mortgage signed without the non-joining spouse can be void. A non-borrowing spouse signs the security instrument and right-to-cancel.

Taxes on a refinance

New Mexico imposes no state mortgage or refinance tax; expect recording fees only. A promulgated title reissue discount may reduce the title premium based on the prior policy age, subject to the underwriter.

Cash-out & consumer protections

Cash-out limits follow investor and agency guidelines, not a state cap. The New Mexico Home Loan Protection Act bans loan flipping on home loans and requires housing counseling on covered high-cost loans, with a net-tangible-benefit standard on all home loans.

New Mexico uses judicial foreclosure. Prepayment penalties are unenforceable on these loans, so most refinances are penalty-free.
