Closing & funding

Closings in northern New Jersey are commonly attorney-conducted while southern New Jersey leans on title companies; title companies can close and disburse refinances. New Jersey is a wet-funding state.

Spousal signing

If a spouse holds an interest (including tenancy by the entirety) or joint-possession rights, that spouse generally signs the security instrument. A non-borrowing spouse signs the mortgage and right-to-cancel, not the note.

Taxes on a refinance

New Jersey imposes no state refinance tax on the loan; you pay recording fees only, not a percentage-of-loan mortgage tax.

Cash-out & consumer protections

Cash-out limits follow investor and agency guidelines, not a state cap. New Jersey requires pre-close housing counseling on high-cost loans and has one of the lowest high-cost fee triggers, with a net-tangible-benefit standard.
