Closing & funding
Massachusetts requires an attorney to conduct a real estate closing, including refinances. Massachusetts is a wet-funding state, so funds are generally available at signing, subject to the federal right-to-cancel window.
Spousal signing
A non-titled spouse generally does not need to sign on a Massachusetts refinance; a declared homestead attaches automatically and does not require a non-owner signature or a re-filing on a refinance.
Taxes on a refinance
Massachusetts does not impose a mortgage recording tax, so a refinance carries flat recording fees rather than a percentage-based tax.
Cash-out & rules
Outside of Texas, cash-out limits follow investor and agency overlays rather than a state cap. Massachusetts requires pre-closing housing counseling on high-cost loans, and a loan made without required counseling can be void. Subject to eligibility and lender guidelines.
