Refinancing in Maryland: what to know

Closing & funding

Maryland refinances are handled by title or settlement agents; only deed and mortgage preparation carries an attorney limit. Maryland is a wet-funding state, so funds are generally available at signing, subject to the federal right-to-cancel window.

Spousal signing

A non-titled spouse generally does not need to sign on a Maryland refinance, since dower and curtesy were abolished and there is no homestead-signing rule. Title vesting controls who must sign.

Taxes on a refinance

Maryland charges county recordation tax (roughly five to twelve dollars per thousand), but a refinance by the same original mortgagor is generally exempt up to the unpaid principal balance, so the tax applies only to new money. A certification is typically required to claim the exemption.

Cash-out & rules

Outside of Texas, cash-out limits follow investor and agency overlays rather than a state cap, so your loan-to-value depends on the program. Subject to eligibility and lender guidelines.

Good to know

Maryland bans prepayment penalties on first-lien residential loans. Maryland foreclosure is quasi-judicial. The recordation exemption on carried-over principal is a real saver on a same-borrower refinance.
