Closing & funding

South Dakota refinances are typically handled by a title or escrow company, with no attorney mandate. Closings are wet, with funds wired at signing and held through the rescission window.

Spousal signing

South Dakota is a strong homestead state. On a homestead refinance both spouses must join, or the mortgage can be void (SDCL 43-31-17), even if only one spouse is on title. Your title underwriter confirms.

Taxes on a refinance

South Dakota does not impose a special tax on a refinance. Expect recording fees only, since a refinance does not create a new deed transfer.

Cash-out & rules

Cash-out loan-to-value follows investor and agency guidelines, not a state cap. South Dakota applies an all-in 36% rate cap, and a loan that violates it can be void.

Good to know

South Dakota uses non-judicial foreclosure. Most current first-lien refinances are penalty-free, and remote online notarization is generally available.
