A closing attorney is customary in Rhode Island, and most refinances close wet (funds wired at signing, held through the rescission window). Some refinances behave more like dry funding.
Spousal signing
Rhode Island is a common-law state. A non-titled spouse generally does not have to sign on a refinance; both sign only if both are on title. Your title underwriter confirms vesting.
Taxes on a refinance
Rhode Island does not impose a special tax on a refinance. Expect recording fees only, since there is no new deed transfer on a rate-and-term or cash-out refinance.
Cash-out & rules
Cash-out loan-to-value follows investor and agency guidelines, not a state cap. Rhode Island does require pre-close housing counseling on high-cost loans, and a net-tangible-benefit standard applies.
Good to know
Rhode Island uses non-judicial foreclosure, and prepayment penalties on first liens are sharply limited (free after year one). Remote online notarization is generally available.
