Refinancing in Washington: what to know

Closing & funding

Washington uses escrow or limited practice officers to close refinances, and it is a dry-funding state, so documents sign and record first and funds disburse a few days later, after the rescission window.

Spousal signing

Washington is a community-property state. Both spouses generally must join to encumber community real estate (RCW 26.16.030), unless the property is separate and quitclaimed. Your title underwriter confirms.

Taxes on a refinance

Washington's real estate excise tax is a deed tax and does not apply to a refinance. Expect recording fees only, though recording surcharges rose in mid-2025 (verify by county).

Cash-out & rules

Cash-out loan-to-value follows investor and agency guidelines, not a state cap. Washington advertising rules require the APR to be at least as prominent as the rate, with no superlatives.

Good to know

Washington uses non-judicial foreclosure and bans prepayment penalties on most loans (some ARMs excepted). Dry funding plus the federal 3-day rescission can lengthen time to fund.
