A Texas mortgage refinance replaces your current Texas home loan with a new one, ideally on better terms. Refinancing in Texas: what to know

Closing & funding

Texas refinances are closed by licensed escrow officers at a title company; an attorney is not required, though document preparation is regulated. Closings are wet, with funds held through rescission.

Spousal signing

Texas has very strong homestead protection (Const. Art. XVI-50). On a homestead refinance, a non-borrowing or non-titled spouse must sign the deed of trust, and a 50(a)(6) cash-out adds a 12-day notice.

Taxes on a refinance

Texas does not impose a special tax on a refinance. Expect recording fees only, since a rate-and-term or cash-out refinance does not create a new deed transfer.

Cash-out & rules

Texas is the one state where cash-out is set by the constitution. A homestead cash-out under Section 50(a)(6) has an 80% combined loan-to-value hard cap, a 2% fee cap on the original principal, a 12-day cooling-off notice, a once-per-12-months limit, and may close only at a lender, title, or attorney office. FHA and VA cash-out are effectively not allowed on a Texas homestead, though a VA IRRRL and no-cash-out rate-and-term refinances are allowed.

Good to know

Texas uses non-judicial foreclosure and has its own state 3-day rescission after closing on a 50(a)(6). A 50(a)(6) loan can later convert to a non-home-equity 50(f)(2) rate-and-term if no cash is taken and the rules are met.
